    Capuchin Province of Mid-America, Inc., a Colorado non-profit corporation, also known as CPMA, a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, is conducting this raffle.  The following rules and regulations covering and regulating the Capuchin Province of Mid-America, Inc.’s Road to Rome Raffle are enacted pursuant to Section 12-9-101 et seq. of the Colorado Revised Statutes and Article XVIII, Section 2 of the Colorado Constitution.  By purchasing a raffle ticket the purchaser agrees to be bound by these rules and regulations.

    1. There shall be a total of three (3) prizes awarded in conjunction with the Road to Rome Raffle:  the Grand Prize, Refer 3 Friends / Buy 3 Tickets Prize, and the Early Bird Prize.

    (a) The Grand Prize shall be six (6) roundtrip airlines tickets to Rome and will include a one-week stay at the Navona Garden Suites’ Papal Suite, Papa Peretti Palace, Luxury Guest House in Rome, Italy (the “Papal Suites”), or in the event the Papal Suites is no longer owned by the donor, a one-week stay at the Navona Gallery’s Michelangelo Luxury Suite in Rome, Italy.  Air travel must originate from, and return to, a major continental United States international airport or other international airport (provided the fare from such international airport does not exceed the average fare from Chicago, Denver, and Los Angeles international airports on the same date of travel).  Included in the Grand Prize is transfer service to and from Rome Leonardo da Vinci (Fiumicino) Airport.  Any related federal, state and local income or excise taxes, applicable gratuities, tips, security or damage deposits, and additional elective costs associated with the Grand Prize are not included and are the sole obligation of the winning party.  The trip will be scheduled for a designated week during August 2012, based on availability and the Grand Prize winner’s preference.  The Grand Prize winner’s preferred dates of travel outside of August will be considered, but are subject to availability and cannot be guaranteed.  Travel must take place between January 1, 2012 – December 31, 2012. The Grand Prize winner is required to submit preferred travel dates to CPMA within thirty (30) days of winning the raffle and must include 1st and 2nd preferred weeks in August.  In the event that the submitted dates are not available, the winner will be asked to submit a new list of preferred travel dates. The Grand Prize Drawing will take place on Friday, December 9, 2011 at approximately 7:00 p.m. Mountain Time at the Governor’s Residence at the Boettcher Mansion, 400 E. 8th Avenue, Denver, Colorado 80203.  All raffle tickets purchased (except the Refer 3 Friends / Buy 3 Tickets raffle tickets which will be issued separately) will be placed in a drum and the winning ticket will be randomly selected from the drum by a CPMA representative or other CPMA designated person.

    (b) The Refer 3 Friends / Buy 3 Tickets Prize shall be four (4) roundtrip airline tickets to Cabo San Lucas, Mexico and a one-week stay at the Esperanza Resort, Punta Ballena, Cabo San Lucas, Mexico.  Any related federal, state and local income or excise taxes, applicable gratuities, tips, security or damage deposits, and additional elective costs associated with the Refer 3 Friends / Buy 3 Tickets are not included and are the sole obligation of the winning party.  The prize must by used between January 1, 2012 -December 31, 2012.  Air travel must originate from, and return to, a major continental United States international airport or other international airport (provided the fare from such international airport does not exceed the average fare from Chicago, Denver, and Los Angeles international airports on the same date of travel).  The Refer 3 Friends / Buy 3 Tickets Prize winner is required to submit two (2) preferred travel dates to CPMA within thirty (30) days of winning the raffle, but travel dates are subject to availability and cannot be guaranteed.  In the event that the submitted dates are not available, the winner will be asked to submit a new list of preferred travel dates.   The Refer 3 Friends / Buy 3 Tickets Prize Drawing will take place on Friday, December 9, 2011 at approximately 6:50 p.m. Mountain Time  at the Governor’s Residence at the Boettcher Mansion, 400 E. 8th Avenue, Denver, Colorado 80203.   All Refer 3 Friends / Buy 3 Tickets Prize raffle tickets will be placed in a drum and the winning ticket will be randomly selected from the drum by a CPMA representative or other CPMA designated person.  The winner of the Refer 3 Friends / Buy 3 Tickets Prize will also be eligible to win the Grand Prize.

    (c) The Early Bird Prize shall be two (2) roundtrip airline tickets to San Diego, California and a 3-night stay at the Manchester Grand Hyatt San Diego Premiere Presidential Suite.  Any related federal, state and local income or excise taxes, applicable gratuities, tips, security or damage deposits, and additional elective costs associated with the Early Bird Prize are not included and are the sole obligation of the winning party.  The prize must by used between January 1, 2012-December 31, 2012. Air travel must originate from, and return to, a major continental United States international airport or other international airport (provided the fare from such international airport does not exceed the average fare from Chicago, Denver, and Los Angeles international airports on the same date of travel).  The Early Bird Prize winner is required to submit three (3) preferred travel dates to CPMA within thirty (30) days of winning the raffle, but travel dates are subject to availability and cannot be guaranteed.  In the event that the submitted dates are not available, the winner will be asked to submit a new list of preferred travel dates.  The Early Bird Prize Drawing will take place on Friday, October 14, 2011 at approximately 9:45 p.m. Mountain Time at the Grand Hyatt Denver Downtown at 1750 Welton Street, Denver, Colorado 80202.  All raffle tickets purchased within the timeframes set forth in Section 10.(1) below (other than the separately issued raffle tickets for the Refer 3 Friends / Buy 3 Tickets Prize) will be placed in a drum and the winning ticket will be randomly selected from the drum by a CPMA representative or other CPMA designated person.  The winner of the Early Bird Prize will also be eligible to win the Grand Prize.

    2. Refer 3 Friends / Buy 3 Tickets Drawing:  Eligible raffle ticket participants who buy three (3) raffle tickets or buy one (1) raffle ticket and refer three (3) friends who each buy at least one (1) raffle ticket and acknowledge the eligible raffle ticket holder on the referral line of the raffle ticket order form by providing the eligible raffle ticket holder’s name, telephone, and email address, will be issued a separate raffle ticket for the Refer 3 Friends / Buy 3 Tickets raffle through which they will be entered into the drawing for the chance to win the Refer 3 Friends/Buy 3 Tickets Prize.  For each unique group of three (3) raffle tickets purchased or unique group of three (3) friends referred plus one (1) ticket purchased, the eligible raffle ticket participant will automatically receive one (1) new raffle ticket for entry into the Refer 3 Friends / Buy 3 Tickets drawing.  Eligible raffle ticket participants can receive multiple raffle tickets for the drawing, one (1) entry for a person who buys one (1) ticket and has three (3) referrals and/or one (1) entry for every set of three (3) raffle tickets purchased.  Combinations of raffle ticket purchases and referrals are not allowed.  For example, two (2) raffle tickets purchased and one (1) friend referred does not qualify either participant for entry into the Refer 3-Friends / Buy 3-Tickets Drawing.

    3. Each prize is subject to, and each prize winner is fully responsible for, any and all federal, state, and local income or excise taxes, fees, and like charges associated with the prize (“Taxes”).  CPMA and all contracted associated parties have no responsibility for the payment of any Taxes or fees associated with the prize.  At the time of this printing, federal law requires that corresponding tax withholding on prize values of $5,100 or greater must be collected from winners upon award and distribution.  The current withholding rate is twenty-five percent (28%), and each prize winner shall be obligated to pay to CPMA the equivalent of twenty-five percent (28%) of the fair market value of the prize for withholding purposes. Please consult your tax advisor for any questions.  If a raffle ticket purchaser is unable to pay the Taxes associated with the prize at the time the prize is awarded, then that person will be automatically disqualified and an alternate winner will be drawn.

    4. The fair market value for each of the prizes is estimated as follows: the Grand Prize package is estimated at $19,595; the Refer 3 Friends / Buy 3 Tickets Prize is estimated at $10,750 – $25,087, depending on the season; and the Early Bird Prize is estimated at $5,500.

    5. The price per chance is as follows: $50 for one (1) raffle ticket, $135 for three (3) raffle tickets purchased together, $220 for five (5) raffle tickets purchased together, and $400 for ten (10) raffle tickets purchased together, subject to a $100 maximum discount per transaction.  Only one person may be listed as the owner of each ticket. When utilizing the multi-ticket purchase discount, only one person may be listed as the owner of the multi-ticket series.  For purposes of the Refer 3 Friends / Buy 3 Tickets Drawing, the original purchasers of the tickets will be the qualifying party for the Mexico Raffle, provided that they meet the stated requirements.  All purchases of raffle tickets are non-refundable for any reason except a raffle cancellation.  In the unlikely event the raffle is cancelled (in accordance with Colorado Secretary of State Rule 9.A.S.), all credit cards will be credited with the full amount that was paid to the raffle within forty-five (45) days and all parties paying by check or cash will be sent a refund within forty-five (45) days.  All of the credit card and electronic check raffle ticket purchases online will be processed by http://clickandpledge.com/ Corporation.  Raffle tickets are payable by any of the following means:

    (a) On-line Credit Card Payments:  On-line credit card payment may be made at www.brownrobe.org.  Credit card payments are processed immediately and raffle ticket(s) is/are issued following credit card approval.

    (b) Mail-In Form: Official entry form can be downloaded from www.brownrobe.org.  Completed forms and payments with check or credit card information may be mailed to: 3613 Wyandot St., Denver, CO 80211.  Checks should be made payable to: CPMA (Capuchin Province of Mid-America, Inc.).  A purchaser who purchases raffle ticket(s) with a check may pick up the purchased raffle tickets at the CPMA Administration Building at 3613 Wyandot St., Denver, CO 80211 during normal office hours, Monday-Friday, 9 a.m. – 4 p.m. Mountain Time after 14 days of CPMA’s receipt of check, provided CPMA has received clearance from purchaser’s bank.  Alternatively, the purchased raffle tickets eligible for the Early Bird Prize may be picked up on October 14, 2011 after 6:00 p.m. Mountain Time at the Grand Hyatt Denver Downtown, 1750 Welton St., Denver, CO 80202 or, if the purchased raffle tickets are not eligible for the Early Bird Prize, on December 1, 2011 after 4:00 p.m. Mountain Time at the Capuchin Province of Mid-America Administration Offices, 3613 Wuandot street, Denver.     (c) In Person:  Raffle tickets may be purchase in person at the CPMA Administration Building at 3613 Wyandot St., Denver, CO  80211 during normal offices hours, Monday-Friday, 9 a.m. – 4 p.m. Mountain Time.

    6. Checks and credit cards purchases will be deposited upon receipt.  Checks returned for insufficient funds or other reasons, or credit cards that are denied shall disqualify the raffle ticket(s).

    7. Per Internal Revenue Service regulations, the raffle ticket purchase price is not deductible for income tax purposes as a charitable deduction.

    8. All prize winners will be notified by phone and/or e-mail and certified mail within seven (7) days of each drawing.  CPMA will notify all winners by U.S. postal service certified mail; return receipt requested, who have not claimed their prize(s) within thirty (30) days of the drawing.  The notification shall state the prize won, a telephone number of a contact person, and the time and location where the prize(s) can be claimed.  If the prize(s) have not been claimed within thirty (30) days of the receipt of the notification, CPMA may retain the prize or offer it in another raffle.

    9. By entering this raffle, entrants accept and agree 1) to be bound by all the rules, limitations, and restrictions set forth herein (the “rules and regulations”), and 2) that their names and/or likeness may be disclosed to and used by the news media, may otherwise be used by CPMA for publicity purposes, may be published in any newspaper, and may be announced on the Brown Robe Benefit Website (www.brownrobe.org).  CPMA’s interpretation and application of the rules and regulations shall be final.

    10. Raffle Ticket Entry Deadlines:

    (a) All electronic entries must be received and processed by Friday, October 14, 2011, 8 p.m. Mountain Time and all entries by check must be received by Friday, September 30, 2011 to be eligible for and entered into the Early Bird Drawing.

    (b) Refer 3 Friends / Buy 3 Tickets Prize Deadline:  All electronic entries must be received and processed by Thursday, December 8,  2011, 5:00 p.m. Mountain Time and all entries by check must be received by Friday, December 2, 2011 to be eligible for and entered into the Refer 3 Friends / Buy 3 Tickets Drawing.

    (c) Grand Prize Deadline:  All electronic entries must be received by Thursday, December 8, 2011, 5:00 p.m. Mountain Time and all entries by check must be received by Friday, December 2, 2011 to be eligible for and entered into the Grand Prize Drawing.

    11. Winners need not be present to win.

    12. Requirement: Participants must be 18 years of age or older to enter the raffle and to be eligible for prizes.  Winners may be required to provide proof of eligibility including driver’s license, social security number, and applicable contact or verification information. Winners may also be asked complete a Publicity Release Form.

    13. The odds of winning the Grand Prize will be one (1) divided by the total number of raffle tickets actually sold.  If the number of raffle tickets sold is less than 1,500 by the time of the raffle drawing, the Grand Prize may exclude airfare.  A maximum of 5,400 raffle tickets will be sold.

    14. CPMA NEITHER MAKES NOR PROVIDES REPRESENTATION, GUARANTEE, OR WARRANTY, EXPRESSED OR IMPLIED, IN CONNECTION WITH THE GRAND PRIZE, REFER 3 FRIENDS / BUY 3 TICKETS PRIZE, OR EARLY BIRD TRAVEL PRIZE THAT ARE AWARDED IN CONJUNCTION WITH THE RAFFLE.  PURCHASER TICKET HOLDER ACKNOWLEDGES AND AGREES THAT CPMA IS NOT RESPONSIBLE NOR LIABLE FOR THE CONSTRUCTION OR CONDITION OF THE VACATION PROPERTIES AND/OR COMPLICATIONS, DELAYS, LAY-OVERS, OR OTHER ISSUES THAT ARISE WITH RESPECTIVE AIRLINE CARRIER(S).

    15. Prizes are not transferable.  The Road to Rome Raffle is subject to all applicable federal, state, and local laws and regulations and is void wherever prohibited or restricted by law.

    16. Forfeit/decline procedure. In the event that the winner of any of the raffle packages elects to forfeit or decline their prize, the Capuchin Province of Mid-America will acknowledge their forfeiture/decline by phone and/or e-mail and certified mail within seven (7) days of each drawing.  Upon return receipt from the USPS of the certified mail piece’s delivery confirmation of the first winner’s declination of the prize, CPMA will draw the name of a second winner within seven (7) days.

    17. Net proceeds of the Road to Rome Raffle are solely for the benefit of the Capuchin Province of Mid-America, Inc., a 501(c) 3 non-profit organization registered in Kansas and authorized to transact business in the State of Colorado.

    18. Each raffle ticket purchaser hereby releases CPMA and its directors, employees, residents, affiliates, donors, and the owners of the prizes awarded in this raffle from any injuries, losses, or damages of any kind arising in connection with, or as a result of, this raffle and/or that person’s failure to win or redeem any prize, or that person’s award, acceptance, or use of any prize, or that person’s failure to comply with applicable law; and (b) releases and agrees to indemnify, defend, protect, and hold harmless CPMA and its directors, employees, residents, affiliates, and donors from and against all losses, damages, rights, claims, and actions of any kind arising in connection with, or as a result of, this raffle and/or that person’s failure to win or redeem any prize, or that person’s award, acceptance, or use of any prize, or that person’s failure to comply with applicable law.  Each raffle ticket purchaser hereby represents and warrants to CPMA that he/she has read and understands these rules and regulations and agrees to be bound by these rules and regulations and CPMA decisions, which are final.  In the case of any dispute, CPMA’s decision shall be final. Any liability of The CPMA shall be limited to the raffle ticket price paid.

    19. Subject to the approval of the Colorado Secretary of State, the CPMA may elect to extend the raffle-drawing deadline for the Grand Prize and the Refer 3 Friends / Buy 3 Tickets Prize to an alternative date prior to December 31, 2011. In the event this occurs, the modified information shall be sent to each raffle ticket purchaser by U.S. mail or email at the address listed on the entry form.

    20. Employees, members, and the children and spouses of an employee of CPMA are not eligible to purchase raffle tickets in the Road to Rome Raffle.  In the event that an employee, member, or a child or spouse of an employee of CPMA raffle ticket is drawn for a prize, that person will be automatically disqualified and an alternate winner will be drawn.
